Terms of Service

These Terms of Service ("Terms") govern your use of the Rabbit Reader mobile application ("App") developed and operated by Rabbit Reader ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms constitute an agreement between you and Rabbit Reader only, and not with Apple Inc. ("Apple"). Rabbit Reader, not Apple, is solely responsible for the App and its content.

Eligibility

You must be at least 13 years of age to create an account and use the App. By creating an account, you represent and warrant that you are at least 13 years old. If you are between the ages of 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Description of Service

Rabbit Reader is a speed reading and eye training application that helps users improve their reading speed and comprehension. The App provides:

  • Speed Reading Tools: Multiple reading modes (word, chunk, page, and highlighted) with adjustable speed from 40 to 1,000 WPM and Optimal Recognition Point (ORP) highlighting
  • Eye Training Exercises: Eye Gym workouts (saccades, tracking, peripheral vision, pattern recognition), Sprint Reader timed challenges with comprehension quizzes, Word Shape Detective, Peripheral Pro, and Fade Master
  • Public Domain Library: Thousands of free books sourced from Project Gutenberg
  • Book Uploads: Import your own TXT and EPUB files to read within the App
  • Progress Tracking: Reading statistics, WPM trends, streaks, XP, and achievements
  • Annotations: Bookmarks with labels and colors, text highlights with optional notes
  • Cross-Device Sync: Reading progress, settings, and data synced across up to 3 registered devices
  • Customization: Multiple reader themes, font options, adjustable font sizes, and dark/light modes

License & Scope of Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, and as permitted by the Apple Media Services Terms and Conditions ("Usage Rules"). This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

You may not rent, lease, lend, sell, redistribute, sublicense, or provide commercial hosting services with the App. You may not copy (except as permitted by this license and the Usage Rules), reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App.

User Accounts

You may use certain features of the App without an account, with data stored locally on your device. To access cloud synchronization, premium features, and the full library, you must create an account with a valid email address and password.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.

Subscriptions & Payments

Free Tier

The App offers core functionality for free, including:

  • Basic speed reading modes with speeds up to 350 WPM
  • Sprint Reader exercise
  • TXT file uploads
  • Limited reader themes (1 dark, 1 light)
  • Up to 3 bookmarks and 3 highlights per book

Premium Subscription

Premium features are available through a paid subscription, including:

  • Reading speeds up to 1,000 WPM
  • All eye training exercises and games
  • EPUB file support
  • Full access to the public domain book library
  • All reader themes
  • Unlimited bookmarks and highlights

Free Trial

New users may be eligible for a free trial of premium features (duration set at the time of signup, typically 3 days). During the trial, you may download up to 2 public domain books per day. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate. Any unused portion of the free trial period will be forfeited when you purchase a subscription.

Billing & Auto-Renewal

Subscriptions are available as monthly or annual plans. Payment is charged to your Apple ID account at the time of purchase confirmation. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan. You can manage or cancel your subscription at any time in your Apple ID account settings on the App Store.

Prices are displayed in your local currency and may vary by region. We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of premium features after a price change constitutes your agreement to pay the new amount.

Refunds

All payments are processed by Apple. To request a refund, contact Apple Support or use Apple's "Report a Problem" feature. We do not process refunds directly. If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

User Content

You retain full ownership of any content you import into the App, including books, documents, bookmarks, highlights, and notes. We do not claim any ownership rights over your content.

By uploading content, you grant us a limited license to store, process, and display that content solely for the purpose of providing the App's functionality to you. This license terminates when you delete the content or your account.

You are solely responsible for ensuring you have the legal right to use and upload any content you import into the App. You agree not to upload content that infringes upon the intellectual property rights of any third party.

Public Domain Content

Books available through the in-app library are sourced from Project Gutenberg and Open Library, and are in the public domain. We do not claim ownership of public domain content. Public domain books are provided "as is" and we do not guarantee the accuracy, completeness, or quality of this content.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, disassemble, or derive the source code of the App
  • Distribute, share, sublicense, or resell your account access or any premium features
  • Interfere with, disrupt, or place an undue burden on the App's infrastructure or servers
  • Circumvent any usage limits, trial restrictions, device limits, or access controls
  • Upload content that is illegal, infringing, or that you do not have the right to distribute
  • Use automated systems, bots, or scripts to access or interact with the App
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity

Intellectual Property

The App, including its design, user interface, features, code, graphics, and content (excluding user-imported content and public domain books), is owned by Rabbit Reader and protected by intellectual property laws. The Rabbit Reader name, logo, and rabbit mascot are our trademarks.

All exercise content, training methodologies, and comprehension quizzes within the App are proprietary and may not be reproduced or distributed without our written permission.

You (and not Apple) are responsible for addressing any claims by a third party that the App or your possession and use of the App infringes that third party's intellectual property rights. In the event of any third-party intellectual property claim, Rabbit Reader, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Maintenance & Support

Rabbit Reader is solely responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App. For support inquiries, please contact us at hello@rabbitreaderapp.com.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components.

Reading speed improvements and eye training results may vary by individual. We do not guarantee any specific outcomes from using the App's reading or training features. The App is not a medical device and the eye training exercises are not a substitute for professional eye care or medical advice. If you experience discomfort or vision problems, discontinue use and consult a qualified eye care professional.

Limitation of Liability

To the maximum extent permitted by applicable law, Rabbit Reader shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to loss of data, loss of reading progress, loss of uploaded content, or loss of profits, whether based on warranty, contract, tort, or any other legal theory. Our total aggregate liability for all claims arising out of or relating to the App shall not exceed the amount you actually paid for the App or subscriptions in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, so the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by law.

Product Claims

Rabbit Reader, and not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Indemnification

You agree to indemnify, defend, and hold harmless Rabbit Reader and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you upload to the App.

Account Termination

We may suspend or terminate your access to the App immediately, without prior notice or liability, if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to other users, our infrastructure, or our interests.

You may delete your account at any time from the Settings screen in the App. Account deletion permanently removes all your data from our servers, including your profile, books, reading statistics, exercise progress, annotations, and uploaded content. This action cannot be undone. Active subscriptions must be cancelled separately through your Apple ID account settings; account deletion does not automatically cancel your subscription.

Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control (OFAC), and the International Traffic in Arms Regulations maintained by the Department of State.

Dispute Resolution

If you have a dispute with us, you agree to first contact us at hello@rabbitreaderapp.com and attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days.

If the dispute cannot be resolved informally, any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of the State of New York, United States, and you consent to the personal jurisdiction and venue of such courts.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. This choice of governing law does not affect your rights as a consumer under the mandatory consumer protection laws of your country of residence.

Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App. For example, you must not violate your wireless data service agreement when using the App.

Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and on our website, and updating the "Last updated" date. For significant changes, we will provide at least 30 days' notice before the new terms take effect. Your continued use of the App after the effective date of the revised Terms constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using the App.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rabbit Reader with respect to the App and supersede all prior agreements and understandings.
